Purpose. These terms govern purchases made by individual customers through the Wild Melvie online store. They are designed for worldwide sales and apply together with the product page, checkout information, order confirmation, Shipping Policy, Returns Policy and Privacy Policy.

IMPORTANT: This Agreement does not limit rights that cannot be excluded under the mandatory consumer-protection laws applicable to you. Where local law requires seller-identification, language or consumer information to be provided, that information will be made available through the relevant legal notice or checkout flow.

1. Parties and Scope

This Agreement is between Wild Melvie ("Wild Melvie", "we", "us" or "our") and the individual customer placing an order for personal, non-commercial use ("you" or "your").

By placing an order through the Wild Melvie online store, you agree to this Agreement. If you do not agree, do not submit an order.

2. Products and Product Information

Wild Melvie offers fashion products, including ready-to-wear, resortwear, swimwear and accessories. Product descriptions, composition, care information, sizes, colours, availability and prices are shown on the relevant product page.

We take reasonable care to display products accurately. Colours and details may appear differently depending on your screen or device. Minor variations in colour, texture or finish do not constitute a defect. Please review the applicable size guide before ordering.

3. Orders and Contract Formation

Your order is an offer to purchase the selected product(s). An automated acknowledgement confirms that we received your order, but it does not mean the order has been accepted.

A binding contract is formed when Wild Melvie sends an order or dispatch confirmation. We may decline or cancel an order before dispatch if a product is unavailable, payment cannot be authorised, an obvious pricing or listing error has occurred, or fraud or misuse is reasonably suspected.

If we cancel an order before dispatch, we will refund any amount successfully collected for the cancelled product(s) using the original payment method, subject to payment-provider processing times.

4. Prices, Currency and Payment

Prices, available currencies, delivery charges, taxes, duties and any applicable fees are shown at checkout for the selected market before you submit your order. The price displayed at checkout is the price payable for your order, subject only to correction of an obvious error before acceptance.

You must use a payment method offered at checkout and confirm that you are authorised to use it. Your card issuer or payment provider may apply separate processing or currency-conversion fees.

5. Availability, Delivery and Customs

Wild Melvie may fulfil orders from one of its selected fulfilment locations. Delivery options and estimated delivery times are presented at checkout or in your order confirmation. Any delivery estimate is an estimate only, unless we expressly agree otherwise in writing.

You must provide complete and accurate delivery information. For cross-border deliveries, import duties, taxes, customs-clearance charges and similar destination-country costs are your responsibility unless checkout expressly states otherwise. Customs procedures may cause delays beyond our control.

Risk in the product passes to you when the parcel is delivered to the delivery address or a person authorised by you. Ownership passes once full payment has been received. Please inspect your parcel promptly and notify us through the order-support function on the online store of visible transit damage within 48 hours; this does not affect any mandatory legal rights.

6. Returns and Refunds

Subject to this Agreement and any mandatory rights that apply to you, you may request a return within 30 calendar days after delivery through the return-request function on the Wild Melvie online store.

Returned products must be unused, unworn, unwashed, unaltered and returned with all original tags, packaging, protective liners and accessories intact. For hygiene and safety reasons, swimwear, bodysuits and similar intimate garments may be returned only if the hygiene seal and protective liner remain intact and the item is otherwise in resaleable condition.

We may refuse a return or make a reasonable deduction from a refund where a product has been handled beyond what is necessary to inspect its nature, characteristics and functioning, to the extent permitted by applicable law.

Follow the return instructions supplied through the online store. Do not send any product until a return request has been approved or return instructions have been issued.

Where Wild Melvie includes or issues a return label, use it in accordance with the instructions provided. Unless the product is faulty, incorrect, or local law requires otherwise, return shipping costs are your responsibility.

Original delivery costs, duties and customs charges are non-refundable unless required by law or caused by our error.

After receipt and inspection of an eligible return, we will issue any approved refund to the original payment method within 14 days. Your payment provider may take additional time to make the refund available.

7. Faulty, Damaged or Incorrect Products

If a product is faulty, damaged or materially different from your order, submit a request through the order-support function on the Wild Melvie online store as soon as reasonably possible, with your order number and clear supporting photographs where available.

We will assess the request and, where appropriate and required by law, provide repair, replacement, price reduction or refund. Nothing in this Agreement excludes or limits rights that cannot lawfully be excluded or limited.

8. Personal Data

We process personal data in accordance with the Wild Melvie Privacy Policy. We use your information to process and deliver your order, provide order support, prevent fraud and meet legal obligations. Marketing communications are sent only in accordance with applicable law and your choices.

9. Intellectual Property and Use of the Online Store

All content on the Wild Melvie online store, including the Wild Melvie name, trademarks, logos, product photographs, text, designs and graphics, is owned by or licensed to Wild Melvie. You may use the online store only for lawful personal shopping purposes and must not copy, reproduce, exploit or misuse its content without prior written permission.

10. Liability

To the maximum extent permitted by applicable law, Wild Melvie is not liable for indirect, incidental, special or consequential loss arising from an order. This does not exclude or limit liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot legally be excluded or limited.

Where liability may lawfully be limited, Wild Melvie's total liability in relation to an order will not exceed the amount paid by you for the affected product(s).

11. Events Beyond Our Control

Wild Melvie is not responsible for delay or failure to perform caused by events beyond reasonable control, including transport disruption, customs delay, strikes, natural events, war, civil disturbance, utility failure, public-health restrictions or governmental action. We will take reasonable steps to minimise the effect of any such event.

12. Mandatory Consumer Rights and Disputes

Nothing in this Agreement limits any mandatory consumer-protection right that applies to you under the law of your habitual residence. If a provision of this Agreement conflicts with a mandatory legal requirement, that requirement prevails to the relevant extent.

Please use the order-support function on the Wild Melvie online store first so that we can seek to resolve any issue promptly. This does not restrict your right to refer a complaint to any competent consumer-protection authority or court.

13. General Terms

Wild Melvie may update this Agreement from time to time. The version available when you submit your order applies to that order, unless a change is required by law.

If any provision is invalid or unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. This Agreement, together with the product page, checkout information, order confirmation, Shipping Policy, Returns Policy and Privacy Policy, forms the agreement relating to your purchase.

14. Acceptance

By ticking the checkbox at checkout or otherwise submitting an order, you confirm that you have read, understood and accepted this Distance Sales Agreement, the Privacy Policy, Shipping Policy and Returns Policy. Electronic acceptance has the same effect as a handwritten signature to the extent permitted by applicable law.
